Any order placed by you in the manner described on this website is an offer by you to purchase a particular product for the price (including the delivery and other charges and taxes) specified on this website at the time you place your order.
Sequoia Valley Farms reserves the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order. The rejection of any offer by Sequoia Valley Farms is at the sole discretion of Sequoia Valley Farms.
Your contract with Sequoia Valley Farms only comes into existence when we forward confirmation of receipt of your order and payment to you.
All parcels are sent by Australia Post using registered post, Sendle, a courier company of your choice or a courier company that delivers to your address as selected by you or Sequoia Valley Farms. Your signature and suitable identification will be required upon delivery.
Delivery will take up to 3 – 10 working days from receipt of payment depending on where you live. Be aware that this is just an estimate though and factors such as Public holidays and busy periods can affect delivery and that any delays in the postal service is out of our control.
Delivery costs are calculated by weight, box size or parcel size as determined by your order. Sequoia Valley Farms reserves the right to split your order according to what you have purchased and may send it via multiple forms of shipping.
Due to strict biosecurity laws, Sequoia Valley Farms will not sell or allow deliveries to international addresses. Sequoia Valley Farms has the capability to set up rules and conditions in their settings at multiple levels that restrict the sale of prohibited items, based on the customer’s location, communicated and enforced by the customer’s shipping address. Customers who knowingly or unknowingly re-direct or forward items internationally do so at their own risk. Sequoia Valley Farms will not be liable or responsible to the customer or anyone else for the loss and damage of items, punitive damages, penalties, fines or charges as a result of confiscation by Biosecurity officers, State, Federal or International bodies and is the sole responsibility of the customer.
Sequoia Valley Farms reserves the right to restrict the sale of items based on your location. This is done to ensure that Sequoia Valley Farms adheres to Local, State and Federal laws and regulations regarding the transportation, importation, sale of (permitted and prohibited) plant, soil and seed material. Sequoia Valley Farms has the capability to set up rules and conditions in their settings at multiple levels that restrict the sale of prohibited items, based on the customer’s location, communicated and enforced by the customer’s shipping address.
All efforts are made by Sequoia Valley Farms to adhere to Local, State and Federal laws and regulations. Sequoia Valley Farms will accept no responsibility or liability for the import or movement of plant, soil and seed material into Bio-secure and Quarantined areas. Any loss and damage of items, punitive damages, penalties, fines or charges as a result of confiscation by Biosecurity officers, State or Federal bodies is the sole responsibility of the customer. It is the responsibility of the customer to check their local laws and regulations to ensure that the importation of plant, soil and seed material is permitted into their area.
If the customer transports, knowingly or unknowingly, re-directs shipping or sends on plant, soil or seed material to other person(s), or transports previously purchased plant, soil or seed material that was permitted in their original location into an area where Biosecurity laws prohibit the transport of purchased plant, soil or seed material, Sequoia Valley Farms will not be liable or responsible to the customer or anyone else for the loss and damage of items, punitive damages, penalties, fines or charges as a result of confiscation by Biosecurity officers, State or Federal bodies and is the sole responsibility of the customer.
All prices are subject to change without notice. Online prices may vary from prices available elsewhere. All final prices, products and offers include GST at the rate of 10%. You are responsible for the payment of any and all taxes, duties, charges, imposts or other liabilities imposed by any government agency, government taxation agency or other government body in Australia, including without limitation, any additional duties, or taxes imposed on any products or services acquired or ordered by you from this website.
Unforeseen supply problems or unexpected demand may occasionally result in stock being unavailable, however all items are promoted as being available at the time of display. Although we make every effort to keep sufficient stock of items listed on our site, occasionally we do sell out of certain products and sizes. If we are out of stock on an item you have ordered, we will notify you via e-mail. Where there is to be a significant delay in dispatch of your products (due to availability) Sequoia Valley Farms will contact you via e-mail and give you the chance to modify your order.
Our products are shipped once payment has been received and the items are in stock. Even though we make every effort to keep a sufficient level of stock occasionally we do sell out of product. If product is out of stock at the time of purchase, we will endeavour to restock it within a reasonable time frame.
Shipping and handling charges are dependent on where you live and the weight of the items you purchase.
Subject to payment, property and risk in the goods passes to the customer upon delivery of the goods to the customers nominated address. Sequoia Valley Farms will not accept any liability or responsibility for any loss or damage of goods that occur during delivery.
The customer will be able to see the shipping costs at the checkout stage, before finalising payment for the order.
The customer must ensure the correct delivery address is entered during the ordering process. The goods must be signed for by you for delivery. If a signature is unable to be obtained a card will be left behind informing the customer on how to collect the delivery. Parcels will be held by the delivery service for their maximum held time. Should the customer not respond to the card left behind and the delivery is returned to Sequoia Valley Farms as unclaimed, the customer will incur further delivery charges. Freight charges for the original delivery are not refundable. Sequoia Valley Farms will accept no responsibility or liability for the incorrect inputting of address details by customers whilst ordering.
We will accept deliveries to PO Boxes. If you do not collect goods within an acceptable time frame from the PO Box address, and, this results in the degraded condition of the product, Sequoia Valley Farms will not accept liability.
The customer is responsible for examining the goods immediately after delivery. Sequoia Valley Farms is not liable for any mis-delivery, shortage, defect or damage unless Sequoia Valley Farms receives details in writing within forty-eight (48) hours of the date of delivery of the goods. In addition, Sequoia Valley Farms will not be liable to the customer or anyone else for any losses suffered or incurred due to delay in delivery or any lost, damaged or stolen goods that are the result of transportation by Australia Post, Sendle or any other courier company.
We recommend that you create an account with us so you can track your orders, save payment methods, store shipping and billing addresses and create a wish list. Your order can be placed on hold for up to 7 days in your cart. Once you have checked out and paid for your order, we cannot amend it. If you do not want your order shipped, you must contact us in writing within 24 hours to either cancel or place your order on hold, before fulfilment of your order is completed. Cancellation requests made within 24 hours of purchase will incur an administration fee of $5.95. Requests made after 24 hours, and post fulfilment will defer to the change of mind clause regarding refunds.
Held orders will incur a $10 fee, incurred for each week the order is held, up to a maximum of four (4) weeks to cover the labour and maintenance costs to maintain your plants.
If you choose not to take up your plants after four (4) weeks, your order will be automatically forfeited and not eligible for refund.
Sequoia Valley Farms will make every effort to accommodate customers with exceptional circumstances. Please contact us via email or webform and a customer service representative will review and make every effort to work with you to achieve the best outcome possible.
Sequoia Valley Farms takes pride in the quality of its products and implements stringent quality control checks. Sequoia Valley Farms ensures every plant leaves our premises in ideal condition. Sequoia Valley Farms hydrates and treats each plant before it is carefully packed. We safeguard the health and quality of each plant before it is sent to you and ensure that it leaves our site in ideal condition for transportation.
Once the plants leave our care and Australia Post or the freight company accepts our plants, our responsibility for the condition of the plants ceases. If your order is incorrect, arrives in poor condition or there is a problem with your plants on arrival, please contact us directly via our website contact forms or via email at sales@sequoiavalleyfarms.com.au or via our contact number +61 476 404 940 within 48 hours of delivery.
Please provide your full name, address, order number, photographic evidence and a description of the problem to help us assist with your enquiry. Â If you do not make contact via phone, the website or email within 48 hours of receipt, we will not accept responsibility for any issues or delivery problems. Photographic evidence will be submitted via email so a representative can assess, diagnose and take steps to remedy the problem.
Contact over social media platform(s) to remedy issues is not a substitute for the above methods. Any contact over social media accounts to remedy issues is strongly advised against, as we do not check these accounts regularly.
We strongly recommend taking postage insurance at time of checkout with Australia Post. We will endeavour to work with you to find a suitable solution and will review such incidents case-by-case.
If you receive item(s) that you did not order or are determined to be in poor condition by an customer service representative, we will issue a store credit for the value of your plants and or mail you replacement plants if we have those available.
If you order an item that produces foliage or flower colour, and upon leafing or flowering is not the item or variety you ordered, we will waive the 48-hour contact provision. You must follow the contact methods outlined as soon as the issue is noticed. Photographs, receipt of purchase and order number is required to verify the purchase. We will issue a store credit for the value of your plants and or mail you replacement plants if we have those available.
Sequoia Valley Farms is not liable to accept any returned goods, but at its discretion will accept the return of goods, provided that written approval is obtained from a duly authorised representative of Sequoia Valley Farms. Goods returned for credit that are not the result of issues with the item, as determined by an customer service representative, will be subject to a handling and administration charges equivalent to 10% of the invoiced value of the returned goods. Return freight and other expenses will be paid for by the customer and no returns of special goods will be accepted. Any returned goods must be accompanied with the relevant invoice numbers and/or a Goods Return Authority, obtained from a customer service representative via email. All claims must be lodge within 14 days of receiving the product. Refunds will not be administered for change of mind, incorrect item(s) ordered, and item(s) bought in error. Shipping costs are non-refundable.
If you would like to proceed with a replacement, please email us at sales@sequoiavalleyfarms.com.au after which a customer representative will organise for the replacement to take place.
Please be aware a postage charge may apply to a replacement or refund.
You agree to indemnify Sequoia Valley Farms against any or all liabilities, damage, loss or claims where such loss or liability arose out of or in connection with a breach of this Agreement by you, or the publication or distribution of material or information supplied to the website by you, or any complaints or charges made by other parties against you.
You also agree that access to, and use of this website, is at your own risk.
Sequoia Valley Farms reserves its right to discontinue its website, whether temporarily or permanently and/or any of the facilities available on its website, to you, without notice.
