These terms apply to your use of the website and to any order you place with us. By using this website or placing an order, you accept these terms. If you do not agree with them, please do not use the site.
Orders and acceptance
When you place an order, you are making an offer to buy. A contract is formed only once we confirm your order. We may decline or cancel an order — for example where an item is unavailable, where stock has sold out, or where there has been a pricing or description error — and if we do, we will refund any payment for that order.
Some plants are offered as pre-orders or limited reserves. Where that applies, the dispatch window and any specific conditions are shown on the product or campaign page and form part of your order.
Pricing
All prices are shown in Australian dollars (AUD). We are not currently registered for GST, so no GST is added to your order. We may correct pricing or description errors at any time.
Product information
We describe and photograph our plants as accurately as we can. Because plants are living and individual, the specimen you receive may vary in size, form and detail from the photographs, which are representative rather than exact, and sizes and pot specifications are given as a guide. Because much of our stock is living, seasonal or sourced to order, availability can change and is not guaranteed until your order is confirmed.
Payment
Payment is processed securely by our third-party payment providers, including card, PayPal and Afterpay options. We do not store your full card details.
Delivery and returns
How we dispatch and deliver is set out on our How to Order & Delivery page, and returns and refunds are covered by our Returns & Refund Policy. Please read both — they form part of these terms.
Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits or excludes those guarantees. To the extent permitted by law, our liability for failing to meet a consumer guarantee is limited to replacing the goods, supplying equivalent goods, or refunding the price.
Using this website
While we make every effort to keep the website accurate and available, it is provided “as is”. We make no warranty that the information is complete, current or error-free, or that the site will always be available. Nothing on this website is professional advice. You are responsible for protecting your own devices, and we recommend scanning any downloaded files.
Limitation of liability
To the maximum extent permitted by law, Sequoia Valley Farms will not be liable for any indirect, incidental, consequential or special loss — including loss of profit, data, goodwill or anticipated savings — arising from your use of this website or any linked website. Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
